If the seller's name is not on the title, a good assumption would be that their name is also not on the registration card, subsequently the vehicle may have never been registered by them. They may be the owner of the vehicle, if they legally obtained it, but they not a registered owner of the vehicle yet. They more than likely did not reported the purchase in 10 days to the DMV as the required by law in order to avoid pay taxes and registration fees. The exception may be if this person had power of attorney to sell the vehicle on behalf of the true owner. If not, they committed the act of being an unlicensed dealer. This will not stop you from registering the vehicle in your name, however the DMV will need a statement from the seller explaining why they did not register the vehicle as required by California law. The DMV will want his or her complete information including driver license number, a signed Statement of Facts (REG 256) form with previous owner information, as well as all bill of sales to validify ownership. The DMV might require you pay a secondary fee for a title transfer and registration which was required before your purchase.
